Grounds for and purposes of processing personal data

The processing of personal data is based on Article 6(1)(c) of the EU General Data Protection Regulation (2016/679). The processing of personal data is necessary for the performance of our statutory tasks.

In addition, the processing of your personal data may be based on

• Legitimate interest (e.g. to compile and process statistical data, to further develop our activities and to investigate possible abuses)
• Mandatory legislation (for example, the obligation to keep records under the Accounting Act)
• Consent given by you

In principle, we will process your data for the purposes of organising income support under the Unemployment Insurance Act (1290/2002) and the alternating allowance under the Alternating Workers’ Allowance Act (1305/2002), and for providing advice and services in relation to membership. It may also be used to assess and improve the quality of the service.

Whose data do we process?

As a general rule, we only process the personal data of our members.

In addition, we process information about people who have been members, applied to become members, otherwise contacted us or visited our website. In addition, we may collect information from individuals who have a membership interest, obligation or other connection with the membership relationship.

In addition, we maintain control data for payments:

• The salary on which the daily allowance is based for the claimant and the length of the adjustment period
• The member’s wage or salary, the length of the adjustment period and certain social benefits which affect the amount of the benefit payable
• The member’s child information affects the payment of child increases to the member, as well as the Kela’s collection of child allowances
• Recoveries of benefits paid by us (collections, Kela collections)
• We collect cumulative data on the benefits we pay to a member
• Benefit days paid
• Benefits paid and decisions issued to the member
• Letters we send to members
• Work declared by the claimant
• The register contains information on the persons from whom we recover or have recovered a benefit paid
• The necessary information on the benefit to be recovered

  • We identify the caller by telephone number when it is a member of ours. We record the time of the call, the duration of the call and the identity of the person who handled the call. We record calls to customer services in order to protect the rights of the parties involved. We may also use these recordings to improve the quality of customer service. The recordings are made in a secure manner and we do not use the recordings for any other purpose or disclose them to third parties.
• Tax information
  • Every year, the tax authorities forward to us the withholding tax data of their members. Members can also submit a tax card themselves. We maintain this withholding information in a register.
• Employment relationships of the daily allowance claimant
• Employment policy statements issued to the daily allowance claimant
• Information transmitted to us by the Social Insurance Institution
• Number and name of the member’s employment and economic development office
• Free field for additional information
• Information on whether the member has authorised another person to deal with his/her case

We monitor customer experience through feedback surveys. We collect the person’s membership number in the register if we send a feedback survey based on the OmaYTK application. We collect the telephone number of the person if we send a feedback survey based on a call to customer service. In addition, we keep a free-form response written in the open field of the questionnaire. We may link the respondent and the response.

Members can ask questions and provide feedback through the online service and change their contact details. Questions, answers and requests for changes will be recorded in the register.

Sources of personal data

We receive information from the application for membership and benefits submitted by the individual.

In addition, we receive information on the basis of Chapter 13 § 1 of the Unemployment Insurance Act (1290/2002) on

• From central and local government and other bodies governed by public law
• from the Pension Security Centre, the Pension and Insurance Institution and the Pension Fund
• from the employer, contractor or other person performing the work, the unemployment fund, the workplace fund, the provider of educational services within the meaning of the Act on Public Employment and Business Services and other educational institutions, and
• any other provider of services to promote employment

From the Labour Market Authority, we receive the statement referred to in Chapter 1, Section 4(3) of the Unemployment Security Act and other information related to payment and appeals.

From the Penitentiary Service, we receive information on the start and end of the sentence. The penitentiary institution provides this information immediately when the person is admitted to the penitentiary institution.

We receive information from Kela if a recipient of earnings-related daily allowance or his or her spouse is granted home care allowance under the Act on Support for Home Care and Private Care of Children.

We also have the right to obtain from the Tax Administration, free of charge and without prejudice to confidentiality provisions and other restrictions on access to information, information on the income of unemployment benefit recipients that is necessary to investigate abuse of unemployment benefits.

For the purpose of processing the benefit claim and for monitoring purposes, we obtain wage data from the National Register of Income.

Also

• Every year, the tax authorities provide us with the tax withholding information of the members of the fund
• Kela provides us with information on the benefits paid by Kela to benefit claimants
• The Population Register Centre provides us with information on members’ addresses, children and deaths
• The Labour Administration provides us with labour policy statements concerning members

With the consent of the member, membership and contact information may be processed and received between the YTK Unemployment Fund and YTK Worklife.

We maintain the quality of the data by updating the personal data through the information services of the authorities.

Who processes your personal data and with whom can we share your personal data?

Our staff’s right to process members’ personal data is determined by the authorisation to use it in accordance with the job description.

External service providers authorised by us may also process personal data on a limited basis. They process data on our behalf and for our account. In such situations, we will enter into a binding agreement between the parties for the processing of personal data, taking into account data protection and confidentiality requirements. Ownership of the data is never transferred from us to a third party and the third party has no right to use the data beyond the scope of the mandate.

We may also share information with public authorities on the basis of Chapter 13 of the Unemployment Insurance Act. Such sharing is based on law or data protection obligations.

We may also disclose data to the Electronic Exchange of Social Security Information between EU countries (EESSI).

We may also disclose information to other bodies, such as the new unemployment fund of a member who has resigned or been dismissed and the social security office, if the member agrees.

In the case of joint members of the YTK Unemployment Fund and the YTK Worklife, contact details are processed and received between the parties on the basis of the member’s consent. Membership information is shared between the YTK Unemployment Fund and the YTK Worklife on the basis of the YTK Worklife membership condition.

Do we transfer your personal data outside the EU?

In principle, we do not transfer data outside the European Union or the European Economic Area. In some circumstances, we may use resources and servers located around the world to provide our services. In these cases, we may transfer your personal data outside the country where the services are used and possibly to countries outside the EU and EEA whose laws do not provide specific protection for personal data or whose data protection laws are very different. In these cases, we will ensure that there is a legal basis for the transfer and that the user’s personal data is protected in accordance with applicable law, for example by using standard contracts approved by the relevant authorities and by requiring compliance with appropriate technical and practical data protection measures.

How long do we process your personal data?

We will process your personal data for as long as we have a valid ground for processing as described in this Privacy Policy and for a reasonable period thereafter.

We may also have a legitimate interest or legal right to process your personal data for a certain period after your membership has ended.

Data storage and security

We only collect personal data that is necessary and relevant to the purpose of the processing. We do not collect or retain more or longer than is necessary for the purposes for which it is collected.

The secure maintenance and destruction of the media on which we process personal data ensures that personal data is not unlawfully disclosed to third parties. The IT equipment and the computer network are physically protected and located in a locked and controlled area. They are also protected by firewalls and other technical measures as appropriate.

Access to the register is restricted to persons authorised by us. Access to data, programs and systems is restricted by technical means (user IDs, passwords) only to persons performing the tasks of the YTK Unemployment Fund.

Access to premises where confidential data are processed or archived is restricted to persons who need access for the performance of their duties. The external doors of our production premises are covered by a control system. The access of employees is controlled by means of an access control system. The users of the register are subject to a confidentiality agreement and are therefore not allowed to pass on the information they process.

How can you exercise your rights in relation to your personal data?

As a registered user, you have several possibilities to influence the processing of your personal data. We will respond to your requests as soon as possible, and at the latest within one month. If we need more time, we will contact you within one month. Please contact us in the first instance via the OmaYTK service or contact our customer service.

The rights you have include

• Right of access to personal data collected about you
  • Every member can easily check his/her personal data in our online service OmaYTK. There you can also update your contact details and send us a secure message.
  • For personal data, a request for verification can be made by sending a message through the OmaYTK service or by sending a message to [email protected], where further instructions will be sent. The request for verification should specify in detail what data the person wishes to verify and for how long. As a general rule, the request for verification is free of charge once a year.

• Right to request rectification of personal data collected about you
  • If you notice any errors or omissions in your data, you can submit a request for rectification to us. We recommend that you make your request through the OmaYTK service.
• The right to request the deletion of personal data collected about you
  • We are obliged to delete the personal data you have requested from our records if one of the following criteria is met and no other law or regulation imposes an obligation to retain the data
    • the personal data are no longer necessary for the purposes for which they were processed
    • you withdraw your consent and there is no other lawful basis for the processing
    • you object to processing on grounds relating to your particular personal situation and there is no legitimate ground for the processing
    • the processing is unlawful

• The right to request restriction of the processing of personal data collected about you
• Right to request restriction of processing of personal data in accordance with Article 18 of the GDPR
• The right to transfer the data you have provided from one system to another
• The right to receive the personal data you provide us in a structured, commonly used and machine-readable format
