If you are perform payed work without being in an employment relationship in the private or public sector, you are considered to be an entrepreneur for the purposes of unemployment security. Therefore you may be considered to be an entrepreneur even if you were not obliged e.g. to take out a pension insurance for self-employed persons. Such a situation may occur, for example, if you work in small scale through an invoicing company.

A part-owner may also be considered to be an entrepreneur for the purposes of unemployment security, even if there were no obligation to insure under the Self-employed Persons Pensions Act. You are a part-owner and thus an entrepreneur for the purposes of unemployment security, if

  • You work in a senior position in a limited liability company in which you hold at least 15 per cent of the share capital or votes, or you have otherwise similar authority.
  • You work in a senior position in a limited liability company in which your family members or you together with your family members hold at least 30 per cent of the share capital or votes, or you have otherwise similar authority.
  • You work in a limited liability company in which you hold at least half of the share capital or votes, or you have otherwise similar authority.
  • You work in a limited liability company in which your family members or you together with your family members hold at least half of the share capital or votes, or you have otherwise similar authority.
  • You work in another company or corporation in which you, your family members or you together with your family members have authority similar to that referred to above.

So it is essential that you work in a company in which you or your family members have authority. Ownership alone will not make you an entrepreneur.

Ownership cannot be hidden through chains. While evaluating the share of ownership we also take into account indirect ownership. We will take into account indirect ownership, if at least half of the intermediate corporation is owned by you or your family member or you together with your family members, or you hold similar authority in the intermediate corporation.

The law puts family members living in the same household with an entrepreneur in an awkward position. If they work in the company, they can be considered to be entrepreneurs for the purposes of unemployment security, even if the work was done in an employment relationship. That may result in unpleasant consequences, because work done as an entrepreneur will not accumulate the condition regarding employment in an unemployment fund for employees. So in case of unemployment we may not necessarily be able to secure the livelihood of a family member of an entrepreneur.
