Employee to entrepreneur

A person can, as a rule, work as an entrepreneur for 18 months without losing their right to employee’s earnings-related daily allowance. However, if the person has joined an entrepreneur’s fund at the beginning of their entrepreneurship and met the entrepreneur’s working condition, they lose their right to the employee’s daily allowance.

If the member of the employee’s fund has worked as an entrepreneur for over 18 months, they cannot be paid employee’s earnings-related daily allowance before the employee’s working condition has been met again. The working condition of an entrepreneur is only accumulated by entrepreneurial work done as a member of the entrepreneur’s fund, where the possible 18 months’ entrepreneurial work as a member of employee’s fund does not accumulate the entrepreneurial work condition.

If the person becomes unemployed from the entrepreneurial activities before they have met the entrepreneur’s work condition as a member of the entrepreneur’s fund, they are entitled to the employee’s earnings-related daily allowance, to which they would be entitled, if they had become unemployed as a member of the employee’s fund. The transfer from the employee’s fund to the entrepreneur’s fund has had to happen within one month from resigning from the employee’s fund.

Thus a person, who has become an entrepreneur, can decide for a period of 18 months, whether to be a member of an employee’s or an entrepreneur’s fund. During this post-protection period, if they become unemployed, they are paid the employee’s earnings-related daily allowance from the fund, whose member they are.

Entrepreneur to employee

If a person, who has as a member of an entrepreneur’s fund gathered the entrepreneur’s work condition, transfers to an employee’s fund, their right to receive entrepreneur’s unemployment allowance ends when they reach the employee’s work condition as a member of an employee’s fund. In this case the observation period of the entrepreneur’s work condition begins, when the person has rejoined the entrepreneur’s fund.

If a person, who has transferred from an entrepreneur’s fund to an employee’s fund, becomes unemployed before reaching the employee’s work condition, they are entitled to the unemployment daily allowance that would be paid to them, if they still were a member of the entrepreneur’s fund. The previous post-protection is applied, if the person has joined an employee’s fund within one month from resigning the entrepreneur’s fund.
