If, due to your employer’s bankruptcy or other disability to pay, you have not received all payments belonging to you by your employment, you can claim them from income security if certain preconditions are met. The payments you claim need to be unpaid, clear and undisputed salary payments that your employer has not been able to pay.
The income security authorities will inspect your employer’s disability to pay so you do not need to present a clarification about the matter. Please note that only payments which you have applied for within three months from when they became payable can be paid as income security.
Salary paid as income security can be taken into account as salary which your unemployment security is based on if certain conditions are met. A precondition is that the payment received as income security would have been taken into account in your salary definition had it been paid by your employer as intended.
Thus for example holiday compensation or salary for a waiting period – as they are not part of your stable income – are left out of salary definition also when paid from income security.
The TE offices and ELY centers accept income security applications and give guidance in matters concerning income security. The decision in income security is made by the ELY center.
