Exceptions in the time of salary definition
An exception in defining your salary is made when
- you get or have got partial disability pension or
- you get or have got part-time pension or
- you get or have got alternation compensation or
- you have been on a part-time nursing leave.
If you have not fulfilled the employment condition in full again after this kind of situation, the salary, on which the daily allowance is based, is defined by the income preceding the pension, alternation or nursing leave. The level of earnings-related daily allowance is not thus defined according to for example the part-time salary paid during part-time pension. The level of daily allowance stays the same even if you fulfill a new employment condition during pension, alternation or nursing leave. The level of daily allowance is defined in the aforementioned manner until you fulfill a new employment condition in full after ending the pension, alternation or nursing leave.
Please notice that this exception in the time of defining applies only if you have already been a member of the unemployment fund and fulfilled the employment condition at the beginning of the pension, alternation or part-time nursing leave. If for example you have joined the unemployment fund after starting the part-time pension, the salary definition is done normally from the income of the 26 calendar weeks immediately prior to your unemployment.
EXAMPLE 1. Maija has been on a part-time disability pension and in part-time work until 31.8.2012. She then works full time 1.9.2012 – 30.6.2013. After the full time work ends Maija applies for unemployment daily allowance for the first time. Maija has fulfilled the employment condition in full again after the part-time disability pension. Earnings-related daily allowance is defined according to the salary of the full time work that followed the part-time disability pension.
Salary reduction due to production and financial reasons
The salary, which your earnings-related daily allowance is based on, is determined by the situation before salary reduction, if your salary has been reduced due to productional and financial reasons. However, a precondition for this is that your employment condition is fulfilled in its entirety during the time before the salary reduction. The exceptional regulation concerning salary determination has been in use in this form in 2010–2015 and in 2017 its validity is renewed.
The index inspections made to the salary on which the daily allowance is based
The salary definition is always done to work that fulfills the employment condition. The employment condition usually has to be fulfilled within a 28 month examination period. In some cases the income of a longer than 28 month period can be taken into account. This happens for example when the employment condition’s examination period can be prolonged for a valid reason mentioned in the unemployment security legislation. An index inspection is always done to the salary when it has been earned earlier than during the 28 month examination period. Index inspection checks with a salary factor that the salary better corresponds to the present level of income. Finnish Centre for Pensions publishes the salary factor count annually.
The index inspection is always made for the salary, on which the daily allowance is based, in the following cases:
- In case the salary taken into account in the definition has been earned earlier than during the 28 month examination period.
- In the case that the salary on which the earnings-related daily allowance of a person receiving part-time disability pension or part-time pension is based on the income level of the time the pension started. The salary is adjusted with a TEL index and salary factor, if the pension has been paid for at least three years in a row.
- In case the income has been defined based on valid taxation information or other reliable declaration other than salary certificate.
